Terms of Service

Please read these Terms of Service ("Terms") carefully before using ZeroCallix's website or AI voice agent services. By accessing or using our services, you agree to be bound by these Terms.


1. Acceptance of Terms

By signing up for or using any ZeroCallix service, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement on behalf of your business, and agree to comply with these Terms in full.

2. Description of Services

ZeroCallix LLC provides AI voice agent services including but not limited to:

  • 24/7 automated call answering powered by AI
  • Lead qualification, scoring, and AI analysis
  • Appointment booking and calendar integration
  • Automated SMS follow-up (reminders, review requests, missed-call callbacks)
  • Optional outbound AI follow-up calls/messages to callers on your behalf (when enabled)
  • Emergency call routing and smart alerts
  • AI call intelligence reports and analytics dashboard
  • Client dashboard workflow for lead and call tracking

3. Subscription & Payment

Services are billed on a monthly basis. By providing payment information, you authorize ZeroCallix to charge your payment method at the start of each billing cycle.

  • All plans are month-to-month with no long-term contracts
  • Prices are listed in USD and subject to change with 30 days' written notice
  • Minute overages are billed at the per-minute rate for your plan at the end of each billing cycle
  • No refunds are issued for partial months
  • Failed payments may result in service suspension after 5 days

4. Cancellation

You may cancel your subscription at any time by contacting support at support@zerocallix.com. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued. After cancellation, your call transcripts and data are retained for 30 days and then permanently deleted.

5. Client Responsibilities

As a ZeroCallix client, you agree to:

  • Provide accurate business information during onboarding, including your correct business state (used to determine call recording consent requirements)
  • Comply with all applicable call recording laws. ZeroCallix automatically injects consent prompts for the 11 two-party consent states (CA, CT, FL, IL, MA, MD, MI, MT, NH, PA, WA), but you are ultimately responsible for compliance in your jurisdiction
  • Not use the service for illegal, harassing, deceptive, or spam purposes
  • Keep your account credentials secure and notify us immediately of any unauthorized access
  • Ensure your use of ZeroCallix complies with TCPA, CCPA, GDPR, and any other applicable regulations in your industry or location
  • Obtain any required consents from your own customers where applicable (e.g., SMS opt-in for follow-up messages)

6. Call Recording & Data Handling

ZeroCallix processes calls via AI to produce text transcripts. No audio recordings are stored by ZeroCallix. Transcripts are automatically purged after 90 days. You acknowledge that:

  • Call transcripts and AI analysis are stored in our secure database and accessible to your account only
  • We handle CCPA data deletion requests from callers on your behalf — callers can email privacy@zerocallix.com
  • Transcript data is permanently nulled (cannot be recovered) upon deletion or after the 90-day purge

7. White-Label Usage

Pro plan clients may present ZeroCallix's AI services under their own brand to their end clients. You may not resell or sublicense ZeroCallix services without a written reseller agreement. White-label branding must not misrepresent the nature of the service in a way that could deceive end users or violate applicable regulations.

8. Intellectual Property

All technology, software, branding, and content created by ZeroCallix remains the exclusive property of ZeroCallix. Your data (transcripts, business information, call records) remains your property. You grant ZeroCallix a limited license to process your data solely to provide the services described herein.

9. Service Availability (SLA)

ZeroCallix targets 99.7% uptime for its AI voice services. Planned maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party telephony or AI infrastructure providers (Vapi, Twilio, etc.) outside our direct control. Clients may be eligible for service credits in the event of downtime exceeding our SLA, as communicated in their service agreement.

10. Limitation of Liability

To the fullest extent permitted by law, ZeroCallix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including missed business opportunities, arising from your use of or inability to use our services. Our total liability to you for any claim shall not exceed the total amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ZeroCallix and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the services, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. Termination

ZeroCallix reserves the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the service in a manner harmful to others or in violation of law. Upon termination, your data will be retained for 30 days before permanent deletion unless you request earlier removal.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions. Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules.

14. Changes to Terms

We may update these Terms as our services evolve. Material changes will be communicated via email to active clients at least 14 days before taking effect. Continued use of the services after the effective date constitutes acceptance of the revised Terms.
